Seller agreement
This agreement applies to every pharmacy selling on Nexcod Pharmacy. Acceptance is a condition of being listed.
1. Licensing
You must hold a valid retail drug licence for the premises from which you dispense, and a registered pharmacist must be present during dispensing hours. You will keep your licence, GSTIN and pharmacist registration current on your profile, and inform us immediately if any of them is suspended, cancelled or under enquiry.
2. You are the seller
You sell and dispense in your own name, under your own licence. You raise the bill, collect payment and bear responsibility for the goods supplied, their storage, and their expiry.
3. Prescription medicines
You will not dispense any Schedule H, H1 or X medicine without a valid prescription from a registered medical practitioner. You will maintain the prescription register required by law. This obligation is yours alone and cannot be shifted to the platform or the customer.
4. Listings, price and stock
List only products you actually hold. Your selling price may never exceed the printed MRP. Stock shown online is your live POS stock — keep your POS accurate.
Every listing needs at least three photographs that you took yourself, of the actual product. Manufacturer catalogue images, images copied from other websites or marketplaces, watermarked images and stock photos are not permitted, and infringing images will be removed. Repeat infringement ends your listing.
5. Conduct towards customers — read this
Cheating a customer is the fastest way off this platform. Taking money and not delivering, supplying an expired or counterfeit medicine, charging above the confirmed amount, substituting a medicine without telling the customer, refusing a legitimate refund, or misusing a customer's phone number or prescription — each of these is a serious violation.
Consequences escalate: a written warning, then a strike, then suspension of your store, then permanent removal and forfeiture of any pending payout. Where the conduct also breaks the law — the Drugs and Cosmetics Act, the Consumer Protection Act or the Bharatiya Nyaya Sanhita — we will report it to the Drug Control authority and the police, and we will cooperate fully with them. We may also inform affected customers of the action taken.
6. Customer data
Customer names, numbers, addresses and prescriptions reach you only to fulfil that order. You may not use them for marketing, sell them, or share them with anyone. You must keep them confidential and delete them when the law no longer requires you to hold them.
7. Commission and payouts
The commission shown in your seller panel applies to orders received through the platform. Where the platform collects money on your behalf in future, payouts follow the payout schedule shown there, less commission and any refunds or chargebacks. Under the current WhatsApp checkout, you collect payment directly from the customer.
8. Suspension and termination
We may suspend or remove your store at any time for a licence problem, a pattern of complaints, fraud, or a breach of this agreement. You may leave at any time, after completing orders already accepted.
9. Indemnity
You indemnify Nexcod POS against claims arising from the goods you supply, the way you dispense them, and any breach of law or of this agreement by you or your staff.
